Terms and Conditions
Please Note for Domain Registration and Website hosting the account will be activated within 24 hours after the payment is credited into the Sysmic's Account.
The Customer has to provide the complete Address details. Sysmic will have complete rights to cancel any domain / hosting if the details furnish online are NOT found correct or may ask for the physical documents if required for any legal process.

Website Development
Sysmic undertakes all Corporate and individual Website development work. The websites are developed using open source framework.
For all website Development Sysmic will responsible only for Designing and technical Support.
Sysmic will provide all support to its client in approx 3-4 working days related to any development challenge during the development phase.
After the website is hosted, Client can opt for Periodic Maintenace for support services.
Sysmic will take No responsibility of Website going down for any reason unless the maintainece is done by Sysmic.
All the Content (text and graphics) has to be provided by client and has to be verified before making the site live.
SYSMIC will take NO Responsibility for any copyright issue arising after uploading the website.

Below are terms that can suspend your account due to abuse on our servers.
Please remember you are on a shared server and everyone is entitled to the server resources. This is a guideline for the users of shared hosting solutions at SYSMIC and we will work with you so that you are not in violations of these terms.

CGI Scripts
Any scripts that pose a potential security risk or are deemed to be adversely affecting server performance or network integrity will be shut down or will be automatically removed without prior notice. SYSMIC does not permit CGI script sharing with domains not hosted by SYSMIC or any scripts that may be abused for UCE purposes.

Unlimited Hosting Space/Bandwidth
Our shared and reseller hosting accounts do come with unlimited hosting space/bandwidth. But we start each account with a set limit but as you needs grow, simply contact us to request additional resources and we will increase it to whatever you need. This new plan allows us to create more efficient use of our servers and provide better, faster, and more efficient hosting for our customers. Please note hosting space is intended for hosting and not intended for online backup, storage device for multimedia content such as movies, music, photos, or other media. Any use of our hosting service in this manner will be considered a violation of our terms of use and will result in automatic suspension of the hosting account without any prior notification. Also the Unlimited space on shared server is subject to Max of 75000 INODES of maximum of 15GB space for fair usage.

Change in Primary Account (Domain) Hosting
All hosted accounts are allowed a change in the primary domain name free of cost within the first 15 days of the purchase of hosting service. After 15 days change in the primary domain name will attract a processing fee of Rs.1500/- per account change.

Software Distribution
SYSMIC Web Hosting and Ecommerce accounts are not configured for the purposes of distributing software and/or multimedia products. This includes but is not limited to file sharing, torrents, warez, and pirated material.

Multimedia Files
Multimedia files are defined as any graphics, audio, and video files. SYSMIC Web Hosting and Ecommerce accounts are not to be used for the purposes of distributing and storing multimedia files. Any Web site using the space for storing multimedia files will be considered violating our terms of use and will result in deletion of such files and/or automatic suspension of the hosting account. Web Hosting accounts come with a limit of 2,50,000 (INODES) files per account.

Databases
Any database stored on SYSMIC Web Hosting and Ecommerce servers will be limited in size to as per the plan of the initial quota setup allotted for that particular domain's plan/web hosting account.

CPU and Memory Limit
All accounts will be only allowed to use 5% of cpu and memory and can not exceed a session longer then 5 min. This includes all database uses, email, cron jobs, and any FTP sessions.

DATA Security.
Sysmic is taking all the services from World best Hosting providers / Datacentres. We ensure that best of the class support and infrastructure is given to our customer, how ever due to any avoidable circumstance, Issues from Datacentre / vendor / third party for any downtime - Sysmic will take No responsibility of the Data or losses from it. However the liability of SYSMIC will be ONLY to provide similar or near similar WEb Hosting / email hosting services which was provided to client. It will be the responsibility of customer to reupload the web content / configure the website / email ids. The secondary web hosting / email hosting will be provided if the primary server or service by primary vendor is NOT restored in 7 working days.

Email Limitation
Outgoing emails are limited to 100 per hour per user or 300 Per domain or 1000 per day whichever is reached first. This limitation is per hosting account.

Unlimited Hosting Space/Bandwidth

We have fair usage policy of maximum of 15GB space on Shared servers

Service Abuse

Below are terms that can suspend your account due to abuse on our servers.

  • Not allowing Video streaming sites,
  • Not allowing Audio streaming sites,
  • Not allowing free audio / video sites, download / upload sites,
  • Not allow Bulk Email / Email Marketing or any sites related to it
  • Not allow Free Web Hosting sites, Sites with illegal content.
  • Not allow Null Script.
  • Crack Software / Null script should Not be used.
    There will be No refund provided for any such activity.

Spam Mail Policy

Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to SYSMIC customers. The term "spamming" also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a Web site hosted on a SYSMIC server, and selling or distributing software (on a Web site residing on a SYSMIC server) that facilitates spamming. Violators will face immediate suspension. SYSMIC reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision.

SYSMIC Bulk Email ANTI-SPAM POLICY

SYSMIC Marketing has a no tolerance spam policy. SYSMIC provides a facility from leading providers that enables users to send email messages to others. Users must not use this facility to send unsolicited, or indiscriminate messages, whether or not for commercial purposes. SYSMIC Marketing’s customer support actively monitors large import lists and emails going to a large number of contacts. Any customer found to be using the products offered by SYSMIC or its vendor for spam will be immediately cut-off from use of the product. If you know of or suspect any violators, please notify us immediately at support@sysmic.co.in Every email contains a mandatory unsubscribe link – those individuals who try to remove this link will be warned that they are doing so. If the link is removed or deactivated in any way, SYSMIC Marketing will terminate the customer’s account.

What is Spam?

Spam is an unsolicited email also known as UCE (Unsolicited Commercial Email). By sending email to only those who have requested to receive it, you are following accepted permission-based (opt-in)email guidelines.

What constitutes a Pre Existing business relationship?

The recipient of your email has made a purchase, requested information, responded to a questionnaire or a survey, or had offline contact with you.

What constitutes consent?

The recipient of your email has been clearly and fully notified of the collection and use of his email address and has consented prior to such collection and use. This is often called informed consent.

Isn’t there a law against sending Spam?

The federal anti-spam law in the US went into effect on January 1st, 2004 and preempts all state laws. The EK follows the GDPR which was enforced from 25 May, 2018. While this new law will not stop spam, it does make most spam illegal and ultimately less attractive to spammers. The law is specific about requirements to send commercial email and empowers the federal government to enforce the law. The penalties can include a fine and/or imprisonment for up to 5 years. The IT Act 2000 in India prohibits malicious communication through electronic means.

How SYSMIC Marketing protects you from sending spam

SYSMIC Marketing is a permission-based email-marketing tool that follows the strictest permission-based philosophies:

  • Communication – Your registration page should state why you are collecting the site visitor’s email address, how you plan to use their address, and that you are following the embedded privacy policy. Additionally, by accepting our agreement you have agreed to use only permission-based lists and never to sell or rent your lists.
  • Verification – You should send all of your new contacts an email confirming their interest in receiving emails from you. Additionally, if your contact changes his or her interests or unsubscribes, you should automatically sends an email confirmation.
  • Unsubscribe – Every email generated from SYSMIC OR its partners products contains an unsubscribe link which allows your contacts to opt-out of future emails and automatically updates your contact lists to avoid the chance of sending unwanted emails to visitors who have unsubscribed.
  • Identification – Your email header information is correct because it is pre-set for you. Your email’s “From” address is verified and already accurately identifies you as the sender.
  • Contact Information – All of your emails are pre-filled with your contact information including your physical address.

How to protect yourself from sending Spam:

Take the Spam Test

  1. Are you importing a purchased list of ANY kind?
  2. Are you sending to non-specific addresses such as:
    sales@domain.com, business@domain.com, webmaster@domain.com, info@domain.com, or other general addresses.
  3. Are you sending to distribution lists or mailing lists which send indirectly to a variety of email addresses?
  4. Are you mailing to anyone who has not explicitly agreed to join your mailing list?
  5. Have you falsified your originating address or transmission path information?
  6. Have you used a third party email address or domain name without their permission?
  7. Does your email’s subject line contain false or misleading information?
  8. Does your email fail to provide a working link to unsubscribe?
  9. Are you failing to process any unsubscribe requests that come to you via a reply to your email within 10 days or the request?

Refund Policy

Please take a moment to read and familiarize yourself with SYSMIC Hosting/Domain Refund Policy. This Refund Policy is in place to ensure SYSMIC’s Hosting is able to provide the highest level of service possible. By registering for any of SYSMIC’s Hosting services, you are stating that you have read and accept all of the terms and conditions outlined in this Refund Policy.

Section (1) - Refund Policy for New Accounts
Web Hosting Account - All newly purchased web hosting accounts are covered by a 15 day money back guarantee. Should you become dissatisfied with our services at any point within the first 15 days of holding an active account, we will refund your money in full (less 10% card commission if you have paid online using Payment Gateway) unless otherwise specified at, or prior to, the time of purchase. Notification of your intent to cancel your web hosting account must be given prior to the 15th day of your contract. We shall cancel all our services / terminate all the accounts (including third party tools applications such as outlook.com, google apps or any other application integrated by us and refund will be initiated. In case of abuse of Control Panel / hosting service or transfer of service (after FREE period) to any other vendor - Sysmic will immediately terminate all the services provided by us or by our vendor and there will be NO refund provided for the same. Sysmic will NOT be responsible for any loss of Data due to termination or Deletion of any services.

Domain Names - All newly purchased domain names are final sale at the time of purchase. You are the sole owner of any domain name/s registered through our services upon payment in full. Should you decide to leave our service for another provider, domain names are transferable and therefore not subject to refunds. Outgoing emails are limited to 100 per hour per user or 300 Per domain or 1000 per day whichever is reached first. This limitation is per hosting account. The limitation will also vary for any third party application integrated with your domain/services

Section (2) - Refund Policy for Reseller Accounts
Web Hosting Reseller Account - All newly purchased web hosting reseller accounts are covered by a 7 day money back guarantee. Should you become dissatisfied with our services at any point within the first 7 days of holding an active account, we will refund your money in full (less 10% card commission if you have paid online using Payment Gateway). Notification of your intent to cancel your web hosting account must be given prior to the 7th day of your contract.

Domain Names - All newly purchased domain names are final sale at the time of purchase. You are the sole owner of any domain name/s registered through our services upon payment in full. Should you decide to leave our service for another provider, domain names are transferable and therefore not subject to refunds.

Domain Reseller Accounts - All Current Debit Account Balance would be refunded. There should not be any locked funds while requesting a transfer. The refund may take upto 60 days after we get the confirmation from the reseller for the termination of the service.

Section (3) - Refund Policy for Service Renewals
Web Hosting Renewal - Refunds for web hosting account renewals will be Not granted to customers requesting a cancellation of their service after the renewal date. No exceptions will be made to this policy.

Domain Name Renewal - At no point will SYSMIC automatically renew a domain name on behalf of a customer. Customers will receive notification of a domain name's pending expiration prior to the expiration date. It is the customer's responsibility to update us atleast 7 days prior to the epiration date for the renewal of the service. No refunds will be granted for domain name renewals under any circumstances.

Section (4) - Refund Mode
All refunds will be made in the same mode, which the client had used in making the payment for his Invoice. The payment will be done in Full except for the credit card payments where in a 5% Credit Card Charges will be deducted and domain charges which are non-refundable. The amount or any deduction will be refunded via original method of payment within 10 to 15 working days. If customer paid twice for one transaction, or if the amount is twice debited for any reason, the one transaction amount will be refunded via same source within 15 to 20 working days.
